Terms of Service

1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and Shipwright ("we", "us"), an independent product operated by a sole trader based in Sweden. They govern your access to and use of our website, our demo application (accounts, the demo chat, and the dashboard), and the Shipwright starter kit ("the kit").
By accessing the website, creating an account, using the demo, or buying the kit, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.
2. The service
Shipwright provides an informational website, a demo application you can use to evaluate the product, and a software starter kit sold as source code. The demo is offered for evaluation and may change, be limited, or be withdrawn at any time. We do not guarantee the demo will be available, uninterrupted, or error-free.
3. Your account
If you create an account, you are responsible for the information you provide, for keeping your credentials confidential, and for all activity under your account. You agree to provide accurate information and to be old enough to form a binding contract in your jurisdiction. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for abuse, fraud, or unlawful activity.
4. Acceptable use
When using the website or demo, you agree not to:
- Use the service for anything unlawful, or to infringe anyone's rights.
- Submit content, or generate output, that is illegal, harmful, harassing, or that violates the acceptable-use policies of our providers (including Anthropic).
- Attempt to access accounts or data that are not yours, or probe, scan, or breach security or authentication measures.
- Interfere with, overload, or disrupt the service, or attempt to circumvent usage limits, quotas, or rate limits.
- Scrape, crawl, or harvest data from the service except as expressly permitted.
- Reverse engineer or attempt to extract source code from the hosted service, or resell or provide the demo as a service to third parties.
5. AI-generated output
The demo uses AI models to generate responses. AI output can be inaccurate, incomplete, outdated, or offensive, and may not reflect our views. Output is not professional advice of any kind — legal, medical, financial, or otherwise — and you should not rely on it as such.
You are responsible for reviewing and independently verifying any output before you use or rely on it, and for how you use it. To the extent you have rights in the output, you also accept responsibility for ensuring your use of it complies with applicable law and third-party rights.
6. The license
Buying Shipwright grants you a single-developer license: one person may use the source code to build and ship products. You can use the kit in any number of your own projects, commercial or not, with no runtime license checks, attribution requirements, or royalties.
You may not resell, sublicense, open-source, or redistribute the kit itself (or a lightly modified version of it) as a boilerplate, starter kit, template, or competing product. Shipping products built with it is the entire point; re-selling the kit is the one thing that isn't allowed.
Repo access is personal. Don't share your GitHub access with others. For teams, email us for a team license.
7. Updates
Your purchase includes all updates for 12 months from the purchase date: new features, dependency upgrades, and fixes as the underlying APIs (Next.js, Stripe, Better Auth, Anthropic) evolve.
After 12 months, your repo access and license do not expire: everything you have, you keep, forever. You just stop receiving new updates unless you renew.
8. Delivery and refunds
Checkout and payment are handled by Polar, our merchant of record, which also collects and remits any applicable VAT or sales tax. After purchase you'll receive access to the private GitHub repository.
Because the product is source code that cannot be returned, refunds are handled case by case. If something doesn't work as advertised and we can't fix it, you get your money back. Email us within 14 days of purchase.
9. No warranty
The website, demo, and kit are provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that any output will be accurate or reliable.
You are responsible for reviewing the code and determining whether it fits your use case before shipping it to production.
10. Limitation of liability
To the maximum extent permitted by law, Shipwright and the people who operate it will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or related to your use of (or inability to use) the website, demo, kit, or any AI output — even if we have been advised of the possibility of such damages. This expressly includes any third-party API or infrastructure costs incurred by your deployment of the kit.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or USD 100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnification
You agree to indemnify and hold harmless Shipwright and the people who operate it from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the service, your content or prompts, your violation of these Terms, or your violation of any law or third-party right.
12. Third-party services
The service relies on third parties, including Anthropic (AI), Stripe (payments), Polar (merchant of record), and Vercel (hosting). Your use of the service may be subject to their terms, and we are not responsible for their acts, omissions, availability, or content.
13. Changes to the service and these terms
We may change, suspend, or discontinue any part of the service at any time. We may also update these Terms; when we do, we will update the 'Last updated' date above. Material changes will be communicated by reasonable means. Your continued use of the service after changes take effect means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of Sweden, without regard to its conflict-of-laws rules, and the courts located there will have jurisdiction over any dispute, except where mandatory local law gives you the right to bring proceedings elsewhere.
